Dr Barbara Green

Barrister

Barbara has a wealth of experience in a wide range of health and welfare disputes within the Court of Protection and acts in applications at all levels pursuant to sections 15, 16 and 21A of the Mental Capacity Act 2005. She also regularly appears in the National DOLS court at the Royal Courts of Justice and the Family Division of the High Court in applications arising from the deprivation of the liberty of children and young people.

 

Barbara has a Ph.D in Psychology and a M.Sc. in Clinical Psychology. Prior to coming to the Bar she worked in the NHS and private practice as a clinical psychologist and psychotherapist. She continues to have a strong interest in psychology, psychological well-being, and mental illness.

Court of Protection: Health and Welfare

Barbara is regularly instructed to act on behalf of the Protected Person by the Official Solicitor, Accredited Legal Representative and advocates; by local authorities, NHS Trusts and NHS Integrated Care Boards; and by family members.

She has experience in a wide range of Court of Protection cases including complex capacity disputes and best interest matters relating to care, residence, contact, social media, hoarding, alcohol and substance use, and sexual relations.

 

Mental Health

Barbara represents patients at Mental Health Tribunals and is instructed in Nearest Relative Applications. She is experienced in cases which involved the interplay of the Mental Capacity Act 2005 and the Mental Health Act 1983.

 

Mediation

Barbara is an accredited mediator with the ADR-ODR group.
