Community Care

Specialist Areas

Community Care is a huge area and impacts on many peoples lives. A challenge for local authorities and families alike, Spire Barristers can assist and advise across a whole range of issues and disputes.

With a strong connection to Court of Protection work, Spire Barristers are well-placed to provide advice and representation on matters which may require recourse to the Court, or referral for relevant assessments.

Our team comprises members with a range of relevant knowledge and skills, gained from extensive Court of Protection work and direct experience of working in-house as an Adult Care lawyer.

Recent Community Care matters have included:

  • advice to a local authority on safeguarding issues
  • advising and representing a family in respect of a retrospective CHC claim
  • written advice and representations for an appeal of a CHC decision
  • representations in relation to a local authority’s duty to fund eligible needs

Members have provided training on the Care Act, Mental Capacity Act and Deprivation of Liberty. Please visit our Training and Seminars page for details of what we can offer and to arrange a bespoke training package.

Please do not hesitate to contact one of our Public Law clerks
